Chester T. Lane briefs

This nine-volume collection is titled U.S. Securities and Exchange Commission: Briefs in cases involving statutes administered by the Securities and Exchange Commission. The collection contains appellate briefs written by Chester T. Lane, SEC General Counsel 1938-1942, for nearly all of the indexed cases.

The collection includes transcripts, opinions, typewritten materials, and other court documents for the following cases:

Smolowe v. Delendo Corp., 136 F.2d 231 (2nd Cir. 1943) (affirming stockholders' profits-recovery suit under a lowest-price-in, highest-price-out rule and establishing that stockholder plaintiffs are entitled to attorney's fees) (cert. denied, 320 U.S. 751 (1943));

Marine Harbor Properties, Inc v. Manufacturers Trust Company, et al., 317 U.S. 78 (1942) (affirming denial of petitioner's Chapter X bankruptcy petition because petitioner failed to prove it was filed in good faith) (appealed from In re Marine Harbor Properties, Inc., 125 F.2d 296 (2nd Cir. 1942));

SEC v. Chenery Corp., 318 U.S. 80 (1943) (remanding approval of respondent's public utility holding company reorganization plan) (appealed from Chenery Corporation, et al. v. SEC, 128 F.2d 303 (D.C. Cir. 1942)); and

Jones v. Kennedy, et al., 121 F.2d 40 (D.C. Cir. 1941) (vacating allegations against SEC and individual Commissioners while finding no reason to prevent SEC attorneys from representing government officers) (cert. denied, 314 U.S. 665 (1941)). TEST
